Philadelphia Immigration Lawyers: Visa Lottery Program Transparency

Two of America’s top immigration-related advocacy groups have moved forward in filing a lawsuit against the federal government. The lawsuit aims to create more transparency in the H-1B work visa lottery process, which is the most sought-after program for IT professionals, primarily among those working in the industry in India.

Both the American Immigration Council and the American Immigration Lawyers Association have filed the suit against the Department of Homeland Security and U.S. Citizenship and Immigration Services (USCIS). The lawsuit aims to gain information regarding the government’s administration of the H-1B lottery. Both advocacy groups alleged the USCIS has not been forthcoming when explaining the process, according to a statement by the groups.

The legal director of the American Immigration Council has spoken against the secrecy surrounding the process, describing the petitions as disappearing into a “black box.” The director went on to describe further issues when trying to look into the selection process for potential visa workers.  The lawsuit stresses the importance of allowing the American public and immigrants applying in the

lottery system have access to the information and encourages transparency of the process.

The H-1B lottery process is one of many immigration issues recently brought to light. There has been talk during the presidential candidacy debates regarding banning particular religions from entering the country, with backlash from liberal advocates in the form of a new bill that would ban the religious discrimination. However, the lack of transparency raises different concerns than the potential discrimination. This lack of transparency may show a level of imbalance within the immigration process that the general public is largely unaware of.
