The move comes after the administration rolled out a plan to separate families at the border as part of their zero tolerance policy on immigration. That effort saw the separation of at least 2,500 children from their parents or guardians that lasted weeks to even months at a time, often with little contact between them.

Overriding the Flores Settlement Agreement

The plan, revealed in a 200-page report, would circumvent established standards for the care and treatment of children in immigration detention centers. These guidelines are part of a 20-year old court settlement, the Flores Settlement Agreement, which the current administration is seeking to override. Immigration advocates say this plan would disregard the best interests of the children involved. Some have gone as far to suggest that is the plan’s intention.

Currently, the Flores settlement requires the release of children who arrive to the United States with their families within 20 days. The proposed regulations are part of the administration’s ongoing effort to overturn the Flores Settlement Agreement. They say the current lax policies do not do enough to dissuade people from crossing into to the United States without proper documentation, thus creating a larger problem.

The proposed rule would allow the government to establish its own detention centers to house immigrants for the entire duration of their immigration cases, which can take months to years to resolve. Critics say this change would afford the government too much leeway in detaining immigrants, leaving them, especially children, at risk of physical and emotional trauma and abuse. They cite the advice and opinion of medical experts to prove that detention is unhealthy and potentially inhumane to argue against the changes.
