Philadelphia Immigration Lawyers Report: The “Bed Mandate” Requires Immigration And Customs Enforcement To Detain Immigrants

ImmigrationThe controversial “bed mandate” by Congress requires U.S. Immigration and Customs Enforcement (ICE) to keep an average of 34,000 detainees per day in its custody. This quota has steadily risen since it was established by congressional directive in 2006.

Officials at the Department of Homeland Security (DHS) which is charged with enforcing the mandate maintain that they are focusing on detaining undocumented and foreign- born citizens that threaten public safety and border patrols.  Critics, however, express concern that meeting the forced quota could lead to corruption and forced detention of immigrants that would normally be free pending the resolution of their immigration status.  While most immigrant detainees of the past were those with violent histories and those illegally crossing United States borders, the numbers of non-violent detainees is on the rise.  Many foreign-born citizens are also being detained after being incarcerated or completing probationary periods for non-violent crimes.
