Philadelphia Immigration Lawyers Discuss Migrant Children Placed in Care of Sponsors with Criminal Records

When children are apprehended for entering the United States illegally, they are turned over to the Health and Human Services (HHS) Office of Refugee Resettlement (ORR), who are responsible for placing them with either family members or other guardians until their scheduled immigration hearing.

Unfortunately, this does not always happen. The whistleblower, who is familiar with the process and how the system should properly place these immigrants, said that the appropriate background checks are not performed thoroughly and that oftentimes sponsors are not even fingerprinted. Grassley and Cornyn reported that the proper protocols established by the ORR are not being carried out as they should. Sadly, it is the children who are the ones who suffer from this lack of action.

Allegations also include that while supervisors were notified of the concerns over sponsors with criminal history, no action was taken to remove the immigrant children from their potentially dangerous environments.

In a letter to Department of Homeland Security Secretary Jeh Johnson and HHS Secretary Sylvia Johnson, Grassley and Cornyn cited reports that undocumented children were placed with traffickers who were posing as sponsors. The children were forced to endure horrible conditions including being confined to trailers with no beds, 12 hour works days and death threats if they sought help. In 2013, ORR attempted to address the problem when it issued an alert warning of three known fraudulent sponsors, with addresses in Colorado, Iowa and Minnesota, who attempted to illegally claim unaccompanied minors.
